Not Little, But Too Late

Former RWQCB Chairman, Jeffery Young, wasn't man enough to show up.  He left it to Vice Chair,  Dr. Monica Hunter,  to do the right thing:  Vote (which was unanimous) to rescind 45 CDO's and APOLOGIZE to The Los Osos 45 and to the community for the cruel and pointlessly ridiculous "Mad Hatter Tea Party and Torequemada's Auto de Fe Trial," inflicted on them by the previous Regional Water Quality Control Board.

Dr. Hunter had recused herself when the mad "trial" was underway because she lives in Los Osos and so had a conflict of interest on that proceeding.  Which was a shame because she alone apparently knew what the rest of that Board refused to know:  They had  swallowed a false Kool-Aid narrative about the community, carefully fed to them by the former Chief of Staff, a furious, incompetent and equally uninformed Roger Briggs, and his clockwork second-in-command, Harvey Packard.  This false narrative was that Los Osos was some kind of Dogpatch filled with urine-swilling "Anti-Sewer Obstructionist" scofflaws.

Naturally, urine-swilling scofflaws, whose only sin was voting to move a sewer plant out of town, needed punishment in order to bring them to heel.  And what better way to do that than singling out 45 hapless residents, very publicly slap a Cease and Desist Order on their homes, put them through a ridiculous "trial," threaten their homes, and disrupt their lives, in a little piece of illegal electioneering which would, as then-Chairman Young brazenly put it from the dais, get the community to "vote the right way." 

The Mad Hatter Trials were reported on here and the whole sewer debacle thoroughly documented on Ron Crawford's blog at www.sewerwatch.blogspot.com so there's no need to rehash the insanity.  Except to note how these unfair CDOs on only 45 people serves as a window into how looney the Regional Board's policies and procedures had become.

Unlike everyone else in the PZ, The Los Osos 45 were required to pay big bucks to inspect and pump their tanks every three years (despite expert testimony that unnecessary pumping made wastewater discharges worse, not better, and despite the fact that nobody else in town had a similar burden.), send that report to the Board and notify the Board if the property was sold. So, clearly the Board was trying to make some sort of vague "scientific" connection between "water quality" and pumping and inspecting a septic tank on a piece of property that would justify that CDO.

But here's the kicker. The CDO's were put on an individual, not on the property.  If a CDO recipient sells their house, the CDO goes away.  Poof!  A new family moves in.  Same house, same tank, same leach field, same discharge, but no CDO, no expensive pumping, no reporting, nothing.

This, of course, is pointless incompetent bureaucracy run amok.  And has been the operating methods of the Regional Board from day one.  Under Chairman Young's leadership, the Board chose to ignore science, ignore practical reason, ignore common sense and instead allowed frustration, anger, misinformation and their own incompetence and ignorance to lead them into a farce  -- "The Mad Hatter Tea Party Trial" -- a piece of lunacy that would have been genuinely funny had not the consequences to 45 real people and the community been so wasteful and so harmful.

And now, here it was, the final chapter in this epic piece of embarrassment and ex-chairman Young didn't have the guts to even show up.  But Dr. Hunter did and she alone had the courage and decency to acknowledge and apologize to those 45 and to the community as a whole.  The apology was too late, but it was no small thing.

Except to our newspaper of record.  Two days after the meeting the Tribune carried not one word about the vote, or about the apology.  Nothing. Not a surprise, seeing as how they, like the Board, had already swallowed that same false narrative about Los Osos and became water-carriers for the Board.  And  now, when the community finally received an apology --an acknowledgement by the Vice Chair that The 45 and the community had been  wronged by the Water Board -- the community won't read about it in the Tribune.

While deliberately blinding yourself, silencing your critics and burying your mistakes is par for the course for bureaucrats and Boards, for a newspaper, it's inexcusable.

So, congratulations to The Los Osos 45.  While the community (and the Tribune) have forgotten you, Dr. Hunter did not.  While the apology was too late in coming, it did finally arrive and that in itself is no small thing.

Wow Ann! YOU are sure full of yourself righteous indignation. YOU don't even have a CDO and are NOT one of the "45".

Ever really wonder why the waste water treatment system is finally being installed and just why there were so many delays? YOU Ann, were part of the problem! YOU keep trying to fan the dying embers of long dead fire. There is nothing further you can do to attempt to delay the much needed sewer and thankfully, YOU are not going to cause any further increase in the already high cost of this construction. YOUR personal vendetta has actually failed other than cause embarrassment and costly ridicule of this community.

YOU are now sounding like a bitter old maid looking at the end of a barren life.

OMG, I had no idea it was finally lifted! What great news. Thanks much for letting us know.

I agree this is news that needs to be reported.

Do write a letter to the editor. We need to do a little celebrating for those poor homeowners getting their freedom back. Maybe contact Karen Viele at Cal Coast News? And maybe Dave Congalton.

During those interestingest of times, we had occasionally interacted with the media of print and of the projected image. And invariably we were compelled to repeat a phrase born not only of necessity but of sheer self evidency.

"Reporter! Pay attention! It's not just that we are pleading for you to promote our cause, there is an exceptional occurrence here, an [unprecedented unequal enforcement], [a randomly applied punishment], [a judgement without evidence], [ Insert any of several outrageous uniquenesses here]. You are missing your Pulitzer moment right here, this is the most interesting and far reaching story to come out of the central coast."

In the narrative that "earned repeating" it is possible to repeat it and leave out a keyword or two, so " randomly" is noted here as absent in this iteration.

There was no legal physical proof, and that by definition means that if enforcement was justified for 45 then non enforcement on the remainder was a dereliction of regulatory duty.

Monica Hunter is both the most and least appropriate person to lift the noose. She certainly earned the honor of bearing the good news, but had done all she could within the system to eliminate it's placement.

Alon, my quarrel with the Board on the CDO was exactly your point: Goose and gander. Everyone in the PZ should have received some sort of something. But they were after "enforcement on the cheap" (i.e. "show trials, hang a few then intimidate the rest into "voting the right way.")

Anne, Ah, yes, trolls. Fascinating study from the University of Manitoba on the psychological make up of those folks. Not healthy personality traits, shall we say.

And it sure is odd how this thing simply flew under the radar. Of course, I can see why nobody wants to discuss The Los Osos 45. It was such a f--ked up embarrassment for the Regional Board, best just bury it all.

What made this particular proceeding so creepy was the total inability of that Board (and clockwork Harvey Packard) to take in new information and acknowledge new and changing circumstances over time and so adjust their responses accordingly. That utter lack of flexibility and nimbleness in a regulatory body is dangerous.

Here's what Dave tells me when I offer to come on his show to discuss things like the completely innocent CDOers, or how "more than 4,000" LOPZers are now being fleeced (until the year 2034) every time they cut a check for their property taxes:

... and then that's it. Nothing. Just like the worse-than-nothing Trib (and New Times, and CCN, for that matter). It's terrible.

But 2 adults hanging out in AG's city hall after hours? Dave (and the rest) will give that "story" unlimited air time.

Alon got that right. Somebody said that this whole amazing thing would make a great Master's thesis. I said, no, not a Master's, it'd take several PhD theses to even begin to touch this debacle. Interesting and far reaching, indeed.

As for Dave and Karen and New Times and the Tribune, I suspect one of their problems is this is a very, very long and complicated story and media nowadays is all about the 30-second "pitch," preferably something that includes hanky-panky. If you can't complete your story in a few paragraphs, it won't get told. And the reader/listener's eyes will glaze over and they'll turn the page. The days of the large, Pulitzer Prize-winning multi issue in-depth stories is as dead as the Dodo. And the Hideous Sewer Wars is nothing if not multi-issue on steroids.

The odd thing about The Los Osos 45 is that it IS a 30-second, easy to understand story: Voter coercion, unfair targeting and "punishing" the few, regulatory abuse, unbelievable (and hilarious) bureaucratic bungling and piles of money pouring down rat holes. Yet it flew under the media radar because I suspect the media knew that if they tried to answer/explain the WHY of the Mad Hatter "Trial of the 45," they'd be back into a story too complex for them to begin to tell.

An article about the CDOs being lifted is in The Tribune.

This is is not a "very, very long and complicated story." Septic tanks in Los Osos are leaking, polluting the groundwater and the nearby estuary. Enforcement action was taken. Gail McPherson, Ann's crazy Republican bosom buddy, sent the water board names of people who they selected to be part of enforcement proceedings. CDO recipients completely lost their shit. Ann supported lawsuits that drained the Moylans of thousands of dollars, the Paynes more than a grand and a good chunk of Allebe's nest egg. And there's still unpaid legal expenses from Shauna Sullivan.

So congratulations! The CDOs are now over and done with. It only cost more than $115,000 in expenses owed to state attorneys to fight something that would eventually be rescinded anyway. It must be nice to whitewash history and stay ignorant. How are the Brooklyn Dodgers doing these days, Ann?

No, but Ann did much worse.

She promoted the lawsuit by McPherson, which basically admitted in its amended complaint that homes were discharging. That admission actually justified the very thing that the lawsuit was supposedly aiming to eliminate. Knowing this, Ann still promoted the lawsuit because she is a fucking idiot.

In other words, she basically said, "Join this lawsuit because it's Los Osos' only hope, even though there is no chance that it's going to be successful. Please, friends, flush all your hard-earned money down the drain. Oh, you know, it's money that you would have spent on the sewer that would eventually be built." That sewer, by the way, is now a lot more expensive because of lawsuits filed before PZLDF.

So isn't it great that the CDOs are vacated? Let's pop the champagne and give a toast to all the broke, sick and dead Los Osos residents that had their pockets picked by a right-wing sociopath and an aging, ignorant columnist who just won't shut up.

Actually, Anon(s), I did indeed advocate that if the Water Board wanted to hang anyone, they needed to hang the whole town, like put Administrative CAOs on the whole PZ, goose and gander alike. Require everyone pump, inspect, repair/replace if necessary. That, at least, might have improved some ageing systems and had some small effect on wastewater.

But what the Water Board did here instead was wrong. Plain and simple.


The CSD thought it was wrong as well and voted to defended themselves and voted to defend their citizens who had been "unfairly" singled out as well. That legal decision and case was the CSD Board's decision, not mine. I wasn't on the Board.

The CDO holders themselves were free to choose whether they wanted to sign settlement agreements to whatever the water board wanted to do to them or stand up for their rights against being "unfairly singled out." If you had sat in on the various public meetings held to make those kinds of decisions (give in to being "unfairly singled out" or defend yourself) you'd know both decisions were tough and emotionally costly for either choice. And either decision could only be made by each individual. And, of course, either decision was "unfair" to those forced to make them. And entirely unnecessary since, contrary to the false narrative, the majority of this town wasn't "anti sewer," to my knowledge, none of The Los Osos 45 were anti-sewer either and weren't in need of coercion to vote for and build a sewer.

"Served its purpose" (voter coercion) and "Unfairly singled out." Wrong then, wrong now, always wrong, wrong.

No mention in the Trib's follow up of Vice Chair Hunter's apology to the 45.

Well, that's certainly true with the Trib, NT, and CCN (especially that "hanky-panky" part), but Dave? I've heard him use up hour-long blocks to discuss Disneyland, like, a lot of times.

Give me an hour to discuss my recent (o.k... fairly recent) story that exposes how "more than 4,000" LOPZers are being fleeced (until the year 2034) every time they cut a check for their property taxes (including you, Ann), and I'll have all his listeners' hair blown back... in one hour.

I mean, if you lived in, say, Arroyo Grande, which story would you rather hear on Dave's show: Another discussion about Disneyland, OR how "more than 4,000" LOPZers are being fleeced (until the year 2034) every time they cut a check for their property taxes, and therefore, as I also show, have made property tax history in the process.

A mind-blowingly great story... anywhere, let alone a local story, that I've offered to discuss on the air. And Dave's response?:

It had to do with protecting citizens rights from regulatory abuse and overreach. It was a "due process" lawsuit and the fact you think it was about "stopping the sewer" tells me you don't know what you're talking about. You also should go back to read the transcript of PZLDF's very first day in court and what Judge La Barbara's ruling was regarding anyone who initially was a part of the case but who did NOT have a CDO. And as for the CSD's spending money to defend themselves and the 45, you'll have to take that quarrel up with them. I was not on the Board.

"Do you see PZLDF for what it was really attempting?"

And, I guarantee, 99.9999-percent of that "community" will scrunch their foreheads, look at you, and say, "WTF are you talking about, nutjob?"

I mean, we're talking about the same "community" that has "more than 4,000" property owners being fleeced every time they cut a check for their property taxes, and they, 1) don't even know it, and, in PERFECT Los Osos fashion, 2) don't care.

So what do you think the chances are that they now have intimate knowledge of the minutia involving some lawsuit from years ago? (Hint: Zero.)

And, by the way, as Ann knows, it's that #2, above, that got Los Osos into this gigantic sewer mess to begin with.

Monica's apology is very quick: "I want to apologize for the distress (that the "unfortunate" CDOs caused)"

Don't blink, but at least she said it, which is the least that Board could do, considering that that "distress" sent many of those CDOers to the hospital, and worse.

As for Jeff Young? Dude, just resign, and go away. What a friggin' weasel.

Ann is actually wrong (surprise, surprise) about the PZLDF lawsuit. Essentially, the lawsuit attempted to challenge the legitimacy of the Prohibition Zone, despite the matter being adjudicated from prior lawsuits. By challenging the legitimacy of the Prohibition Zone, that takes away one of the most persuasive legal justifications for building a sewer. She says it has nothing to do with building a sewer. It has everything to do with building a sewer.

It goes to show: Just because you have a blog doesn't mean you know what you're talking about.

Incorrect, Anon 2:01. As I said, PZLDF was a process case and "legitimacy" of what and how the CDO's were being done was one of the components to process. There were many legal justifications for building a sewer. The way the PZ was established was one of the most wobbly, not one of the most persuasive. (Take a look at where the leach fields of many homes east of SBB are located vis a vis the creek, and ask yourself, "Uh, now tell me again, what was the criteria for drawing that map?" Then take a look at the houses up the hill on the south side near the green belt, check out their vados zones and ask again, "Uh, what's this about being guilty of "polluting the waters of the State of California???" )
Anon: 5:04.One man ended up being hospitalized several times and died, and I have no doubt that death was hastened by the stress of the CDO Mad Hatter Trials threats etc, another person had to undergo serious medical treatment, triggered by the stress of this ridiculous Trial, anothers' previous illness made infinitely worse, and many more families had their lives disrupted, stressed, burdened with worry. All of which was unfair and unnecessary and stupidly cruel. And it's obvious to me the Anonymice here do not have a CDO and did not and still do not care a fig for what happened to those who did. Which comes as no surprise to me.

A couple people is not MANY unless Ron is trying to sensationalize.

Most did not over-react to the CDO's the way a couple did. Most went along with the law and realized that was part of the long process to finally get LO to move forward.

There were several vocal activists trying to halt the sewer. If anyone should be blamed, it should be those who wanted to battle the State just to fight!

Ann, you and Gail should be ashamed of the damage you created! You played a definite role in the stressful situation you put a few of our neighbors in!

That's the fascinating document that shows Pandora's twisted "fine out of existence" "strategy" -- where, one day after the 2005 recall election (that didn't go her way), she "phoned" Roger Briggs and informed him that she was about to implement her twisted "strategy," and then a bunch of her followers e-mailed Rog demanding that he fine the community of Los Osos, well, out of existence, and that's what got the CDO ball rolling in the first place, back in 2005, and here we are, in 2014, and those exact CDOs that were first started with Pandora's sick "strategy," are now officially terminated, with an apology from the Water Board.

That charming, little gem was from long-time, and current Los Osos Realtor, Jerry Gregory.

And that's the whole "Yin/Yang" point of my "Contrast" post, back in 2006, where I contrast quotes from the CDOers, like this:

"(This prosecution) sends us to the hospital for emergency treatment for high blood pressure, heart conditions, and stress."

... with the quotes from Pandora's sickening "strategy," like this:

"I think your office should be both swift and brutal with enforcement action against my town."

Yes, disgusting, but, like I say, journalistically speaking? AWESOME!

Then, to make that entire chapter SO much sweeter, Pandora, right now, is Supervisor Gibson's official Parks Commissioner. AWESOMER!

And that's why I don't see how Bruce squares all of this up.

I mean, if you listen to the audio of last week's meeting, you'll hear Bruce go to bat for the CDOers, again, by saying things like, "(The CDOs) are a significant source of anxiety for those who received them," and then he urges termination, while, at the same time, the person whose beyond-sick "strategy" to place CDOs on individual property owners in the first place, is Bruce's appointed Parks Commissioner.

So, you know... huh?

That doesn't add up.

Bruce should either keep his mouth shut regarding the CDOs, or find a different Parks Commissioner.

Doing both -- going to bat for the CDOers while keeping Pandora on board -- is disgustingly hypocritical.
