Hey, Where Was Everybody, part Duh!

Last night, at the little white schoolhouse in the park in Los Osos, Maria Kelly and Lynette Tornatsky hosted county representatives to answer some questions concerning the proposition 218 vote for the wastewater project. About 25 people showed up, even though there had been a little notice in the County Roundup section of the Tribune.

When I had mentioned in a previous blog that Paavo Ogren would be the guest speaker at the PZLDF meeting and only a handful of people showed up (about 16? 17? 18?) one "anonymous" wag noted on the comment section of this blog that the low turn out was because EVERYONE hates PZLDF and so he/she would wait to see how huge the turn-out was for last night's meeting, which to him/her would "prove" that EVERYONE loves whatever "group" he/she thinks Maria and Lynette represent. The only thing I could think of on reading that comment was, "How high school. No, how JUNIOR high school."

Sixteen to twenty five out of 15,000. Last night a member of the audience strongly urged the CSD to invite Paavo to come give his powerfpoint presentation (first given at Bruce Gibson's regular Los Osos meetings) since the CSD meetings are televised and a great many people watch the TV, so the best way, besides the various county brochures which can't possibly go into too great a detail or else they'd end up the size of phone books, would be a more complete presentation on the telly.

Meanwhile, Paavo noted that the very large list of questions gathered by Maria and Lynette would be posted on the county's sewer web page along with the answers. Their blogsite is: www.slocounty.ca.gov/PW/LOWWP Paavo said the Q & A's would probably be finished and posted in a few weeks.

A lot of questions concerning the 218 vote are still up in the air, so if you have questions, post them at the website and hopefully you'll get answers as this process continues.

This weekend kicks off the SLO Film Festival, from the 1 - 11th in various venues around town. Great event, great chance to see some wonderful films, there's various workshops you can attend and, of course, the big blowout at the end. Jesus, Ann. You really are a piece of work. I did not say that "everyone hates PZLDF". I said that half the community doesn't trust Gail McPherson. I didn't mean that everyone was in love with Maria and Lynette's group - just that they carry less baggage than Gail, and people might be more likely to attend a presentation that Gail was not in charge of.

I think by now, just about everyone in town has a STRONG distrust for all things MCPHERSON. She was noticeably absent from last nights CSD meeting. It was really "quite refreshing" not to have to listen to all her self serving hype & propaganda. I think she's done about enough damage to this Community, maybe it's time for her to move on & create damage elsewhere. Regarding Lynettes & Maria's "informational meeting", I think they "probably" meant well, but I don't like or trust the fact that they had to have all the questions prior to the meeting. Something about that "format" doesn't seem ligit.

Hi and I promise I won't speak another word of it after this: I have been at events where only a few get to speak but there are few questions answered. I had spoken to several people in the community who had questions but are uncomfortable in groups. It appealed to my sense of fairness that rather than put individuals on the spot and to support having as many questions answered as possible, I thought it was worth a try. 90% of the feedback was positive. I completely understand why this process would not appeal to everyone, just as the CSD meetings have not been appealing to many over the past year and folks are chosing to stay at home. This concerns me that there is a growing sense of apathy within the community. This was an attempt to appeal to a broader spectrum of the community and see what happened.
Thanks to all who came and participated, it was a nice collection of folks that spanned many aspects of our community.

A couple of people still felt a little uncomfortable but appreciated the opportunity to sit with some of the community in a group and just be there. The desire to participate is out there, but how do we tap into it so it becomes collaborative and inculsive? I would encourage other individuals with a sense of the community to put something together that may appeal to another type of personality and slowly but surely, I suspect that we'll have more trust in our groups and be able to sit together more often. Maybe not but I can hope.

I thought that the format of the meeting last night where the County people addressed Prop 218 related questions was OK. There is a lot to cover, and little time for these meetings. I am not interested in seeing the County reps tripped up at these meetings. I am interested in getting as much specific information as possible.

Hats off to you and Lynnette for your efforts.

I hate to sound cynical, but until everyone in the community puts this "us v. them" mentality aside, there will never be a meeting of the minds.

What came before is done and unchangeable. We need to focus on what's next, but you have die-hards on both sides of the fence demanding to get their way and unwilling to give an inch. Then you have the folks determined to foster distrust of the County and the RWQCB, who spread lies with a smile on their face as if they speak the gospel.

It's sickening and disheartening, and I wonder if this community is even capable of change.

I don't agree with the format of last night's 218 meeting. Paavo has come to Los Osos with Bruce Gibson and on his own and these meetings and discussions were open, and the questions didn't have to go to the county first. So, then I ask, why did they conduct it like that last night?

How could any reps from the county get "tripped up" if they were on the up and up?

Snow job! BTW, the house values couldn't possibly go up for 10 years and the county is misleading the community about grants. We are not getting grants. Snow job! The county is not going to tell us about all the "hidden" extra costs that WILL NOT appear on the 218.

People HAVE THE RIGHT TO KNOW ALL THE COSTS INVOLVED BEFORE THEY VOTE.

The RWQCB has destroyed the last year of my live. The cost has been to both financial health and my physical health. Prior to receiving the proposed CDO, I had not been involved in the battle. I just wanted a solution that was environmentally sound. Any distrust I have in the RWQCB was directly fostered by their actions.

Walk a mile in my shoes before you ask me to trust them.

I have walked the same mile and I sure trust the County to build the sewer inspite of you and your obstructionist buddies. The County and the RWQCB are two totally different agencies. To trust one does not require that you trust the other. I believe the County has the potential to deliver a project. The RWQCB is dirty and better keep their hands out of the process.

I am not arrogant and I am not an obstructionist. Many of the 45 victims have suffered health problems. They are a result of the helplessness we have experienced from this "random" selection for persecution.

If you were also selected and still find yourself strong and healthy, I am happy for you. Studies show that cantankerous souls tend to live longer. Maybe the rest of use need learn from your example. Right now we suffer in silence because there are people like you blame us for getting a CDO.

I don't "blame" you. I blame the CSD for halting the project.

The rest of the studies show not only do "cantankerous souls tend to live longer", but whiners create their own illness and suffer noisily.

The RWQCB is not the enemy you try to make them out to be, look much closer at the criminal CSD for spitting in the face of the Water Boards. We are akk getting to pay for such stupidity! Why haven't you gone before the BOD and demanded they resign for the financial damage they have personally caused?

I do so resent that CSD for even considering hiring a lawyer to defend those few of you still fighting the RWQCB. If you want legal representation, then pay for it yourself. The CSD is broke. It's pure insanity to ask for public donations for one service, but then pay an attorney to defend so few. They can't agree on how to conduct an audit that is now 8 months late. They haven't even begun to consider the bankruptcy they deliberatly caused.

I'm handing my own CDO and I'm not running about claiming my health has been ruined or begging for legal assistance. The "process" has taken it's toll on many of us, some of us however, have been trying to work "with" the County and RWQCB, not against them. It's much easier to sleep because they are correct. Good Luck with your CDO and try to relax, it's beyond your control.

Yes, the county can deliver a project, but at what cost to homeowners? $500 or $600 add importing water to that. Yep, that's what they're going to do! By the time you give your check book to them you could pay $1000. a month for what they will stick on you in the next 10 years. Be sure to give all your credit cards also.

Apparently you haven't seen the memos from the county and/or Blakeslee where Sam wanted to stick ONLY the PZ homes with the entire $41 million debt! Wasn't that nice of him? Or the how Blakeslee assured the Howard Jarvis group (last July) that the CDO's would go away if there was a yes on the 218.

You are not being too smart to trust the county. The CDO's have been used to abuse and as a way to get the Roger Briggs, Shirley Bianchi, Pandora project in that will make you lose your home. Yep, Tri-W and gravity. Is that okay with you?

You better wake up and stop being so trusting when all arrows point to a corrupt process on the county's part.

Didn't you hear that the county had illegal liens in the 90's on all homes in the PZ for an unknown amount?? They had liens on your home and didn't inform you about it! Is that okay with you? The county permitted septics that they knew were illegally discharging and built over 1,000 homes! Is that Okay with you? The county never had a septic survey when it was supposed to be done decades ago. That's why we're in the position we're in today. Is that okay with you?

They want your house so they can resell for a higher property tax for them. Is that okay with you?

When will Los Osos wake up? You guys don't have a clue what the financial impact will be on you and everyone else (that's not as rich as Pandora!)

Now the county says they're importing water. It's full of mercury and now I hear another chemical that is been kept secret from the public. But, hey, ask Ms. Sullivan because she was the polluter's lawyer. She knows all about the chemical and how dangerous it is. She went up against the Justice Dept., but the case was settled. Now it's hush hush. Is that okay with you?

If you're "handling" your own CDO then you must be "fighting" the Water Board for your rights just like us, and must not have signed the Settlement Agreement. Or else you simply didn't show up and got your CDO handed to you without a peep. That's how much the Water Board cares about you and your defense of their actions. You got a CDO anyway, and the Water Board got to walk all over your rights without a peep from you. What a lesson in civil obedience. Congratulations.
P.S. I think you're perhaps stretching the truth when you say you're "handling" your CDO. I think you are perhaps "handling the thought of having" a CDO. No one who actually has a CDO or Settlement Agreement with "the date" hanging over their heads could possibly defend the Water Board. The RWQCB had a graduated series of levels of enforcement at their disposal, which they skipped in a mean-spirited plan to get our attention and our vote, and chose instead to give you a CDO (if they really did give YOU a CDO) or coerced you into signing their Cleanup and Abatement Order AKA Settlement Agreement with the threat of ceasing discharge by 1/1/11. What does that mean to you? That they're only trying to help?
P.P.S.
The CSD isn't paying a lawyer to defend me (or I should say, us, if you truly have a CDO). The CSD is a Designated Party. The lawyer is asisting THEM in THEIR appeal, which may help us (and YOU) in the long run. I signed on with the lawyer, too, and make contributions of my own ultimately to help everyone. If we can prevail in retaining our right to live in our homes, that will be good for all. If you truly had a CDO, you would have had this information. If you are truly a CDO holder and don't have this information, why not?

Aw, GAWD! How Junior High School. HALF OF LOS OSOS? O.M.G. O.M.G. Looking at the voting records, 40% of Los Osos pays no attention to anything, which means that half of Los Osos couldn't possibly even know who Gail McPherson is. Sillier still, there were about, wha?, 6-10 more people at Maria's meeting than the PZLDF meeting.Don't think the PZLDF meeting was noted in the Trib, but Maria's was. Gosh, what does that tell us about the "trust" level the community has for Gail McPherson? As I said, Quel Jr. High school.

Have to disagree with you. If I understoood rightly, Paavo said that all the questions Maria gathered will be posted and answered on the county's website. The meeting both at PZLDF & the school house were only an hour long. The questions Mria gathered were PAGES long. There simply was no time to go through them all AND ask other follow up questions. Plus, the point of the meeting was also to GET information from Paavo. It's understandable that the paranoia level in the community is (understandably) high. But, if the point is to GET information, then however you can get it -- in dribs and drabs as it comes in (a lot of the questions asked cannot YET be answered)in meetings after meetings, then that's to the good. I say hats off to Maria and Lynette for gathering the info and having the meeting, hats off to those who sent in questions, hats off to Paavo and the county team which will attempt to answer the questions. Let's hope that HALF the town is paying attention to their and PZLDF's efforts or even knows what those groups are doing.

The term "fighting the RWQCB" is another of those interesting and totally misleading phrases. Like "people who oppose the Tri W plan are "anti-sewer." Or "Los Osos is anti-sewer." & etc.

The CDO required that the holder "pump, inspect, repair" and agree to hook up to a wastewater system by 2011. So far as I know, all the CDO recipients have either/or already "pumped, inspected, repaired" and fully plan to (and have always planned to) hook up to a wastewater system when one gets built. What a good number of CDO recipients are opposing is the legal language that's also contained in the CDO order, the PROCESS by which the CDOs are being done, the failure of due process rights on so many fronts, the pointlessness of the whole CDO process (Tim Cleath of Cleath & Assoc has already testified that pumping, reparing, etc. will have no appreciable impact on the groundwater during the time it'll take to get the county system up and running, yet that's the justification the RWQCB uses to support using the CDO method which means that the whole "point" of the CDOs is scientifically pointless, so why put people through a potentially dangerous legal proceeding, one carrying criminal penalties and a legally framed in such a way as to legally to force people out of their homes for a scientifically pointless process. (and make no mistake, despite the blandishments RWQCB Chair Jeffery Young made that, oh, well, all of that is "speculative." No. THE LANGUAGE in that CDO is the ONLY thing that counts, and there it is, in legal black and white. A board chair's blandishments are meaningless. The text is all.) And THAT is what a handful of citizens is "fighting," NOT the RWQCB. And if they are successful YOU will be the beneficiary of THEIR hard work. (It never ceases to amaze me how readily and willingly some people toss their legal rights away. And how vicious they can be to those people who simply demand their legal rights. Amazing.)

this question came up at Maria's Meeting (as I'll call it. Or maybe M&L's Meeting?) There were two scenarious that Paavo noted. 1. The project would go back to the CSD. 2. The state could step in and build whatever they wanted wherever they wanted and send everyone the bill. It was asked if the state had ever done that before anywhere and I don't think anyone knew. Paavo said he felt the fact that the State legislators passed 27701 meant that they thought this was solvable at the local level, i.e. if they thought this was hopeless at a local level, they wouldn't have passed 27701 and would simply have stepped in right then and built whatever, wherever. Another point Paavo made at the PZLDF meeting was this: In his view, the original CSD lacked the resources to properly handle a wastewater project when it became clear that the original Ponds of Avalon wouldn't work. At THAT POINT, it didn't have the resources (or the will?) to consider other options and was in trouble right there.

Apropos something similar, (CSD vs County) at the M&L meeting, Paavo also made it clear that he thought the Tri-W sewer over-bids were the result of contractors adding on higher bids to cover a perceived risk (dealing with a smaller entity, no secured loan) or adding on higher bids because they knew they were dealing with a smaller entity that they could buffalo. The implications are that the County will NOT stand for that kind of bid run up and because it will have a 218 secured loan and has more "weight" so it won't get buffaloed."

Also of note at the PZLDF meeting, was Paavo's obervation (since he was present at the creation) that the State Water Board KNEW from day one that the SRF loan was unsecured by a 218 type vote. They KNEW the risks involved, but the CSD persuaded them to take that risk and give them the original SRF loan. So, there goes the argument by the SWB that they were shocked! shocked! that his loan was risky and went ker-blooey. Nope, they knowingly never secured it from day one. Interesting.

If the County builds a sewer for us and it is very expensive, it will be because we have examined all of the viable options, understood the cost, and told them through a vote to do so.

If, at some point in the future, it is determined by the water companies that some type of imported supplemental water is needed and the County helps to arrange for it to be delivered, it will be because they were asked by the water companies to do so.

We control our destiny here in Los Osos. What ever has happened, has happened. We decide from here. If the Prop 218 vote fails, it will not be the County's fault. It will be our choice. This is not the County's issue, it is ours. Will we never take responsibility, as a community? Why is it always the other guy who is to blame?

You are absolutely right. I stand corrected. Let me re-phrase:

49.9% of those who voted against the recall (and now, apparently, quite a few of the 50.1% who voted FOR it) don't trust Gail McPherson.

Gail is neither a leader nor a hero. She is a carpetbagger who led the "Lisa Board" down a primrose path, into a futile (and expensive) fight with the regulatory agencies. The District is nearing insolvency, and Gail needs to step out of this mess before she does any more damage.

The legal experts say that the state can't come in and do a project. Paavo knows that.

The county will not get grants, it's a "show" for people to think they will get financial help. The only grants we'll get is Urban Renewal to eminent domain. I'm waiting for the county to bring that up.

Why doesn't the CSD sue Julie Biggs for all the monies she took for herself out of the SRF money. Legal opinion is that she shouldn't have touched that money, especially for her own legal fees and settlements.

To those that say they don't have a choice - bull, bull, bull - you have chosen Sups, a CSD, FIVE CSD board elections. Delay through elections if you want, but it adds up to more delay. Have fun paying for inflation and adequate water.

but it wasn't a typo. It was a play on words. Deliberate. Lord knows I've made plenty of typos, but that wasn't one of them.

FLIM - FILM Not a very funny word play, but a word play none the less.
